A BILL

TO AMEND SECTION 44-7-180, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE STATE HEALTH PLAN, SO AS TO REQUIRE IN THE PLAN THE IMPACT OF THE TREATMENT AND CARE OF PATIENTS WITH ALZHEIMER'S DISEASE AND RELATED DISORDERS.

Whereas, currently in South Carolina there are approximately fifty thousand persons with Alzheimer's Disease and related disorders, and this number is estimated to increase by several thousand new cases annually; and

Whereas, there are scores of public and private facilities, agencies, and organizations that provide various services ranging from day care to medical care to these victims and their families; and

Whereas, in view of the growing incidence of these illnesses, the array of services provided and agencies involved, it is reasonable to conclude that not only does this significantly impact health care costs and resources in the State, but also that gaps in services may exist as well as duplication of services in some instances; and

Whereas, it would be beneficial and cost effective to the State and the citizens of the State for the State Health Planning Committee to incorporate the incidence and impact of Alzheimer's Disease and related disorders on health planning and resources in this State when revising the State Health Plan. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The last paragraph of Section 44-7-180(B) of the 1976 Code, as last amended by Act 511 of 1992, is further amended to read:

"The State Health Plan must address and include projections and standards for specified health services and equipment which have a potential to substantially impact health care cost and accessibility including, but not limited to, the care and treatment of patients with Alzheimer's disease and related disorders. Nothing in this provision shall may be construed as requiring the department to approve any project which is inconsistent with the State Health Plan."

SECTION 2. This act takes effect upon approval by the Governor.
