TO AMEND SECTION 2-1-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CANDIDATES FOR THE HOUSE OF REPRESENTATIVES AND THEIR TERMS OF OFFICE, SO AS TO PROVIDE THAT MEMBERS OF THE HOUSE MAY NOT SERVE MORE THAN SIX CONSECUTIVE TWO-YEAR TERMS IN OFFICE; AND TO AMEND THE 1976 CODE BY ADDING SECTION 2-1-65 SO AS TO PROVIDE THAT MEMBERS OF THE SENATE MAY NOT SERVE MORE THAN THREE CONSECUTIVE FOUR-YEAR TERMS IN OFFICE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 2-1-40 of the 1976 Code is amended to read:
"Section 2-1-40. Any Subject to the limitations contained in this section, any person otherwise qualified by law and the Constitution of this State may file as a candidate and can be elected only in the district in which he is a resident. A person may file for only one House office. Terms of office shall be for two years.
A member of the House of Representatives may not serve more than six consecutive two-year terms. A member of the House of Representatives serving in office on the effective date of this section who has served at least six consecutive two-year terms in the House may continue to serve his then current term after which he must cease being a member of the House for at least one intervening term. Service in another public office does not constitute prior service for purposes of this provision and the serving of a partial term after filling a vacancy is not considered a two-year term for purposes of this limitation."
SECTION 2. The 1976 Code is amended by adding:
"Section 2-1-65. A member of the Senate may not serve more than three consecutive four-year terms. A member of the Senate serving in office on the effective date of this section who has served at least three four-year terms in the Senate may continue to serve his then current term after which he must cease being a member of the Senate for at least one intervening term. Service in another public office does not constitute prior service for purposes of this provision and the serving of a partial term after filling a vacancy is not considered a four-year term for purposes of this limitation."
SECTION 3. This act takes effect upon approval by the Governor.
