TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 48-9-35 SO AS TO PROVIDE FOR REFERENCES TO "SOIL AND WATER CONSERVATION DISTRICTS" TO MEAN "NATURAL RESOURCES DISTRICTS"; TO AMEND SECTION 48-9-10, RELATING TO CITATION OF THE CHAPTER, AND SECTION 48-9-30, AS AMENDED, RELATING TO DEFINITIONS, SO AS TO CHANGE THE REFERENCES TO THE DISTRICTS; AND TO DIRECT THE CODE COMMISSIONER TO CHANGE CERTAIN REFERENCES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 48-9-35. References to `soil and water conservation districts' in this title mean `natural resources districts'."
SECTION 2. Section 48-9-10 of the 1976 Code is amended to read:
"Section 48-9-10. This chapter may be known and cited as the `Soil and Water Conservation Natural Resources Districts Law'."
SECTION 3. Section 48-9-30 of the 1976 Code, as amended by Section 1176, Act 181 of 1993, is further amended to read:
"Section 48-9-30. Whenever used or referred to in this chapter, unless a different meaning clearly appears from the context:
(1) `District' or `soil and water conservation natural resources district' means a governmental subdivision of this State, a public body corporate and politic, organized in accordance with the provisions of this chapter for the purposes, with the powers, and subject to the restrictions herein set forth; in it.
(2) `Commissioner' means one of the members of the governing body of a district elected or appointed in accordance with the provisions of this chapter;.
(4)(3) `Petition' means a petition filed under the provisions of Section 48-9-510 for the creation of a district;.
(5)(4) `Nominating petition' means a petition filed under the provisions of Section 48-9-1220 to nominate candidates for the office of commissioner of a soil and water conservation natural resources district;.
(6)(5) `State' means the State of South Carolina;.
(7)(6) `Agency of this State' includes the government of this State and any a subdivision, an agency, or an instrumentality, corporate or otherwise, of the government of this State;.
(8)(7) `United States' or `agencies of the United States' includes the United States of America, the soil and water conservation service of the United States Department of Agriculture, and any other agency or instrumentality, corporate or otherwise, of the United States of America;.
(9)(8) `Government' or `governmental' includes the government of this State, the government of the United States, and any a subdivision, an agency, or an instrumentality, corporate or otherwise, or either of them;.
(10)(9) `Landowner' or `owner of land' includes any a person who shall hold holds legal or equitable title to any lands lying within a district organized under the provisions of this chapter;.
(11)(10) `Land occupier' or `occupier of land' includes any a person, other than the owner, who shall be is in possession of any lands lying within a district organized under the provisions of this chapter, whether as lessee, renter, tenant, or otherwise;.
(12)(11) `Qualified elector' includes any a person qualified to vote in elections by the people under the Constitution of this State; and.
(13)(12) `Due notice' means notice published at least twice, with an interval of at least seven days between the two publication dates, in a newspaper or other publication of general circulation within the appropriate area or, if no such publication of general circulation be is available, by posting at a reasonable number of conspicuous places within the appropriate area, such the posting to must include, when possible, posting at public places where it may be customary to post notices concerning county or municipal affairs generally."
SECTION 4. The South Carolina Code Commissioner shall change references to "soil and water conservation districts" in the 1976 Code to "natural resources districts" when appropriate funds are available.
SECTION 5. This act takes effect upon approval by the Governor.
