A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-295 SO AS TO PROHIBIT DISPENSING OF CONTRACEPTIVES TO MINORS WITHOUT PARENTAL NOTICE AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 20-7-295. (A) Notwithstanding Sections 20-7-280 or 20-7-290, no state agency shall provide contraceptives to a minor unless the minor's parent or guardian is notified. Contraceptives are defined as appliances, drugs, or medicinal preparations intended or having special utility for prevention of conception. A minor who provides written notice signed by a parent, legal guardian, or grandparent or obtains a judicial order allowing a person to provide contraceptives may receive them. Procedures for obtaining judicial consent must be established by the family court.

(B) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than ninety days."

SECTION 2. This act takes effect upon approval by the Governor.
