A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-31-135 SO AS TO REQUIRE THE STATE LAW ENFORCEMENT DIVISION TO DEVELOP AND IMPLEMENT AN INSTANT CRIMINAL BACKGROUND CHECK SYSTEM TO IDENTIFY A PERSON PROHIBITED FROM RECEIVING A HANDGUN UNDER FEDERAL, STATE, OR LOCAL LAW.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 23-31-135. (A) The State Law Enforcement Division (SLED) shall develop and implement an instant background check system to expeditiously identify a person prohibited from receiving a handgun under federal, state, or local law. The system must be accessible to licensed firearm dealers in the State.

(B) A request for information made pursuant to this section must be filed with SLED. A criminal background check of a person must be completed by SLED before the sale, delivery, or transfer of a handgun to the person."

SECTION 2. This act takes effect upon approval by the Governor.
