A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-96-75 SO AS TO PROHIBIT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL FROM ISSUING A PERMIT TO CONSTRUCT A NEW SOLID WASTE RECYCLING FACILITY OR EXPAND AN EXISTING SOLID WASTE RECYCLING FACILITY TO THE GOVERNING BODY OF ANY COUNTY WHERE THE COUNTY IS CURRENTLY BEING SERVED BY A SIMILAR FACILITY OWNED BY A PRIVATE ENTITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 44-96-75. The department may not issue a permit to construct a new solid waste recycling facility or to expand an existing solid waste recycling facility to the governing body of any county where the county is currently being served by a similar solid waste recycling facility owned by a private entity."

SECTION 2. This act takes effect upon approval by the Governor.
