TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-3-785 SO AS TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION SHALL SUBMIT TO THE GENERAL ASSEMBLY AND THE GOVERNOR A COPY OF THE STATE'S INTERMODAL TRANSPORTATION EFFICIENCY PLAN PREPARED PURSUANT TO THE FEDERAL INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991, TO REQUIRE A RAILROAD OWNER TO NOTIFY THE DEPARTMENT OF TRANSPORTATION OF HIS INTENT TO ABANDON A RIGHT-OF-WAY, TO REQUIRE THE DEPARTMENT OF TRANSPORTATION TO PROVIDE PROPOSED RIGHT-OF-WAY ABANDONMENT OR DISCONTINUANCE INFORMATION TO INTERESTED PARTIES AND TO THE PUBLIC, AND TO REQUIRE RAILROADS TO SUBMIT TO THE DEPARTMENT OF TRANSPORTATION ANNUALLY A LONG-RANGE PLAN FOR RAIL LINES IN THE STATE.
Amend Title To Conform
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 57-3-785. (A) The Department of Transportation shall submit to the General Assembly and the Governor:
(1) a copy of South Carolina's long-range intermodal transportation efficiency plan prepared in accordance with the Intermodal Surface Transportation Efficiency Act of 1991, Public Law 102-240; and
(2) each periodic update to the state's long-range intermodal transportation efficiency plan.
(B) An owner of a railroad right-of-way must notify the Executive Director of the department of his intent to abandon a right-of-way to assist the director in developing the state's long-range intermodal transportation efficiency plan. This notification must be submitted by mail and sent concurrently with the owner's filing for authorization from the Interstate Commerce Commission for abandonment of a line or discontinuance of a line in this State. The department must develop and implement a procedure for providing proposed abandonment or discontinuance information to interested parties and the general public.
(C) A railroad operating in this State shall submit to the department annually a long-range plan for rail lines that indicates the potential for discontinuance of service or right-of-way abandonment."
SECTION 2. This act takes effect upon approval by the Governor.
