A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61-9-415 SO AS TO PROVIDE FOR THE REGULATION OF THE RETAIL SALE OF BEER BY THE KEG BY MEANS OF A KEG REGISTRATION NUMBER, MAINTENANCE OF RECORDS, AND DEPOSIT AND FORFEITURE PROVISIONS, AND TO PROVIDE THAT FAILURE TO COMPLY IS A GROUND FOR REVOCATION OR SUSPENSION OF THE RETAILER'S PERMIT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 3, Chapter 9, Title 61 of the 1976 Code is amended by adding:

"Section 61-9-415. (A) In addition to any other requirements provided by law, a holder of a permit authorizing the sale of beer who sells beer by the keg must comply with the provisions of this section.

(B) Each keg in inventory must have an individually numbered band attached to the handle or neck. The retailer shall maintain a journal in which is recorded the name, address, date of birth, driver's license number of the person obtaining the keg, the keg band number, and the exact time and location the keg is to be used. The retailer shall retain journal entries for not less than six months and the journal entries may be reviewed by any law enforcement officer upon request.

(C) The retailer shall require a deposit of not less than fifty dollars for the keg's return which must be paid in cash, by check, or by credit card. If a keg is not returned with the same keg number band intact, the deposit must be forfeited to the retailer. The dealer shall inform the person obtaining the keg of the deposit forfeit policy.

(D) The expenses of complying with this section must be passed directly to the consumer in the price of a keg of beer.

(E) The requirements of this section are cumulative to all requirements regulating retail sales and purchases of beer and a violation of any provision of this section is a ground for the revocation or suspension of the retailer's permit."

SECTION 2. This act takes effect July 1, 1995.
