A JOINT RESOLUTION REQUIRING THE DEPARTMENT OF REVENUE AND TAXATION TO REGISTER, COLLECT THE BIENNIAL REGISTRATION FEE, AND NOT TO ISSUE IDENTIFICATION MARKERS OR REGISTRATION CARDS TO MOTOR CARRIERS AND SUSPENDING THE PENALTY FOR THE OPERATION OF A MOTOR CARRIER OR VEHICLE WHICH HAS A FADED, EXPIRED, OR MISSING MARKER FROM APRIL 1, 1995, THROUGH SEPTEMBER 30, 1996.
Whereas, pursuant to the federal Intermodal Surface Transportation Efficiency Act of 1991, South Carolina will enter into a reciprocal reporting agreement with other states that will no longer require the issuance of motor carrier registration cards and identification markers contained in Sections 12-31-250 and 12-31-260 of the 1976 Code; and
Whereas, although Section 12-31-260 of the 1976 Code provides for the expiration of registration cards and identification markers on March 31, 1995, these registration cards and identification markers must be in use until this State officially enters into the agreement on January 1, 1996. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Department of Revenue and Taxation requirement
SECTION 1. For purposes of this joint resolution, the Department of Revenue and Taxation is required to register and collect the biennial fee required by Section 12-31-250, and the department is not required to issue identification markers or registration cards pursuant to Section 12-31-250.
Motor carriers shall not be penalized
SECTION 2. The Department of Revenue and Taxation and the Department of Public Safety shall not penalize a motor carrier or vehicle which has a faded, expired, or missing marker while operating in this State during the period from April 1, 1995, through September 30, 1996.
Time effective
SECTION 3. This joint resolution takes effect upon approval by the Governor.
