A BILL

TO AMEND SECTION 8-13-745, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ENTERING INTO CONTRACTS FOR GOODS AND SERVICES BY MEMBERS OF THE GENERAL ASSEMBLY WITH AGENCIES, COMMISSIONS, BOARDS, DEPARTMENTS, OR OTHER ENTITIES FUNDED BY GENERAL FUNDS OR OTHER FUNDS, SO AS TO PROVIDE THAT SUCH CONTRACTS SHALL NOT BE PERMITTED IF THEY ARE IN EXCESS OF ONE HUNDRED THOUSAND DOLLARS IN THE AGGREGATE FOR A FISCAL YEAR, AND TO PROVIDE THAT ANY MEMBER ENTERED INTO A CONTRACT FOR GOODS AND SERVICES ON THE EFFECTIVE DATE OF THIS ENACTMENT SHALL TERMINATE THE CONTRACT OR RESIGN HIS SEAT WITHIN FOURTEEN DAYS AFTER THE EFFECTIVE DATE, SUBJECT TO CERTAIN EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 8-13-745(C) of the 1976 Code is amended to read:

"(C)(1) Notwithstanding any other provision of law, after the effective date of this section, no member of the General Assembly, during the term for which he shall have been elected, or within one year thereafter, or an individual with whom he is associated in partnership or a business, company, corporation, or partnership where his interest is greater than five percent, may enter into any contract or contracts which in the aggregate for a fiscal year would exceed one hundred thousand dollars for goods or services with an agency, a commission, board, department, or other entity funded with general funds or other funds if the member has voted on the section of that year's appropriation bill relating to that agency, commission, board, department, or other entity within one year from the date of the vote. This subsection does not prohibit a member from voting on other sections of the appropriation bill or from voting on the general appropriation bill as a whole a governmental unit authorized by any law passed during the term for which he shall have been elected.

(2) Any member of the General Assembly entered into a contract for goods and services on the effective date of this enactment shall, within fourteen days after the effective date, terminate the contract or resign from his seat in the General Assembly. However, a member shall not be required to resign from office or terminate the contract if termination of the contract prior to term would result in a substantial detriment to the government unit. In such instances, the member shall be entitled to complete the term of the contract, but the member shall not be entitled to renew the contract unless he resigns from his seat.

SECTION 2. This act takes effect upon approval by the Governor.
