TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-1-330 SO AS TO PROVIDE THAT IN A CIVIL ACTION BROUGHT BY OR AGAINST A STATE AGENCY, DEPARTMENT, BOARD, OR COMMISSION, THE PREVAILING PARTY MAY BE AWARDED ATTORNEY'S FEES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 15-1-330. Notwithstanding any other provision of law, in a civil action brought by or against a state agency, department, board, or commission, the prevailing party may be awarded attorney's fees."
SECTION 2. This act takes effect upon approval by the Governor.
