A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-23-407 SO AS TO PROVIDE THAT A LAW ENFORCEMENT AGENCY MAY CONFISCATE AND DISPOSE OF A TOOL OR DEVICE USED DURING THE COMMISSION OF A CRIME.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-23-407. (A) Except as provided in Sections 16-11-920, 16-13-50, 16-13-66, 16-13-175, 16-23-405, 16-23-500, 44-53-520, 44-53-530, 50-15-80, or another provision, a law enforcement agency may confiscate a tool or device used during the commission of a crime after the successful prosecution of the crime.

(B) The law enforcement agency that obtains ownership of an item pursuant to subsection (A) may use it within its department, transfer it to another law enforcement agency or destroy it."

SECTION 2. This act takes effect upon approval by the Governor.
