A JOINT RESOLUTION AUTHORIZING THE COMMISSION FOR MINORITY AFFAIRS TO RECEIVE FUNDS FROM PUBLIC AND PRIVATE SOURCES FOR RESEARCH, FORUMS, TRAINING, AND INSTITUTES AND TO ALLOW THESE FUNDS TO BE RETAINED BY THE COMMISSION AND CARRIED FORWARD INTO FISCAL YEAR 1996-97 AND EXPENDED FOR THE SAME PURPOSES.

Whereas, the Commission for Minority Affairs, established by Act 164 of 1993, will benefit enormously in the conduct of its official duties by the ability to receive monies from public and private sources in order that the commission may conduct research and provide forums, training sessions, and institutes; and

Whereas, monies received from these sources, including registration fees, may be employed for the purposes of the commission only if they may be retained and carried forward and expended for the same purposes in future fiscal years; and

Whereas, the mission of the commission will be aided by its ability to pool both public funds and private contributions in order that it may award grants implementing the commission's program, and that such pooled funds also must be able to be retained and carried forward. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Monies retained

SECTION 1. With respect to the State Commission for Minority Affairs:

(1) Monies derived by the commission from private and public sources may be used to conduct research and provide forums, training sessions, and institutes in furtherance of the commission's goal and these private and public source funds may be retained by the commission and expended for these purposes, and any remaining balances may be carried forward into fiscal year 1996-97 and expended for the same purposes.

(2) Revenues derived from registration fees received from attendance at training sessions, forums, and institutes conducted by the commission may be retained and carried forward into fiscal year 1996-97 and expended for the same purposes.

(3) Monies pooled by the commission from public and private sources for the purpose of awarding grants to address problems in the minority community may be retained and carried forward into fiscal year 1996-97 so that these grants may be awarded for the same purposes.

(4) The carry forwards authorized by this section do not apply to state general fund appropriations for the commission except to the extent otherwise provided by law.

(5) All expenditures of such funds must be made in compliance with all applicable laws and regulations related to the expenditures of state funds.

Time effective

SECTION 2. This joint resolution takes effect upon approval by the Governor.
