STATEMENT OF ESTIMATED FISCAL IMPACT

This bill will have no impact on the General Fund of the State.

Pursuant to Section 2-7-76 of the South Carolina Code of Laws, the Office of State Budget surveyed 12 county members of the FIST Network with eight respondents. Seven respondents indicated no cost associated with the legislation. One respondent indicated increased employee recruitment costs should the county be responsible for hiring the veteran's affairs officer.

A BILL

TO AMEND SECTION 25-11-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COUNTY VETERAN'S AFFAIRS OFFICERS, SO AS TO PROVIDE THAT BY RESOLUTION OF THE COUNTY LEGISLATIVE DELEGATION, THE AUTHORITY TO RECOMMEND THE APPOINTMENT OR REMOVAL OF THESE OFFICERS MAY BE DEVOLVED ON THE GOVERNING BODY OF THE COUNTY AND TO PROVIDE THOSE CIRCUMSTANCES UNDER WHICH THIS DEVOLUTION MAY BE REVERSED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 25-11-40 of the 1976 Code, as last amended by Act 181 of 1993, is further amended to read:

"Section 25-11-40. (A) Subject to the recommendation of a majority of the senators representing the county and a majority of the House members representing the county, the Director of the Division of Veterans' Veteran's Affairs shall appoint a county veterans veteran's affairs officer for each county in the State, whose terms of office shall begin July first of each odd-numbered year and shall continue for a term of two years and until their successors shall be are appointed. Any such A county veterans veteran's affairs officer shall be is subject to removal at any time by a majority of the senators representing the county and a majority of the House members representing the county.

(B) Notwithstanding the provisions of subsection (A) of this section, the county legislative delegation may by resolution devolve the authority of the delegation under subsection (A) to the governing body of the county and, upon such devolution, a county veteran's affairs officer recommended for appointment by the governing body of the county is considered a county official for all purposes except that this status does not affect the receipt of state funds otherwise due county veteran's affairs officers for compensation and administrative support. The county legislative delegation may by resolution reassume its authority under subsection (A) but only on the expiration of the term or any vacancy otherwise occurring with respect to the county veteran's affairs officer."

SECTION 2. This act takes effect upon approval by the Governor.
