A BILL

TO AMEND SECTION 61-9-360, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE TEMPORARY SPECIAL FUNCTIONS BEER AND WINE SALES PERMIT, SO AS TO ALLOW THESE SPECIAL PERMITS TO BE ISSUED ONLY FOR FUNCTIONS IN JURISDICTIONS WHERE PERMITS AUTHORIZING SUNDAY SALES OF ALCOHOLIC BEVERAGES IN SEALED CONTAINERS OF TWO OUNCES OR LESS ARE ALLOWED PURSUANT TO A FAVORABLE VOTE IN THE REFERENDUM REQUIRED FOR SUCH PERMITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 61-9-360 of the 1976 Code, as added by Section 1586, Act 181 of 1993, is amended to read:

"Section 61-9-360. The department may issue permits running for a period not exceeding fifteen days for a fee of ten dollars per a day. Such These special permits shall be issued are issuable only for locations at fairs and special functions located in jurisdictions in which the temporary permits authorized pursuant to Section 61-5-180 are issuable."

SECTION 2. This act takes effect on the first day of the second month following approval by the Governor and applies to fairs and special functions held on and after that date.
