A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-305 SO AS TO REQUIRE AN AUTOMOBILE INSURER TO PROVIDE PRIOR WRITTEN NOTICE TO ITS INSURED OF THE INTENTION TO PAY A CLAIM OF ANOTHER PERSON UNDER THE POLICY COVERING THE INSURED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-77-305. Notwithstanding any other provision of law, no automobile insurer doing business in this State shall, without exception, pay a claim of another person under a policy of insurance unless the insurer provides prior written notice to its insured of the insurer's intention to pay the claim. For the purposes of this section, the required `prior written notice' must be evidenced by a form signed by the insured and dated by the insured before the date of payment of the claim, and the notice must state the amount intended to be paid, the name of the payee, and the reason for the payment."

SECTION 2. This act takes effect upon approval by the Governor.
