A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-5-40 SO AS TO DESIGNATE THE SECRETARY OF STATE TO MONITOR ALL ELECTED OR APPOINTED STATE BOARDS, COMMISSIONS, AND JUDICIAL OFFICES IN ORDER TO ASCERTAIN WHEN VACANCIES OCCUR AND PUBLICIZE THESE VACANCIES AND POSITIONS ON THESE BODIES WHOSE TERMS EXPIRE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 1-5-40. (A) The Secretary of State is designated as the state office whose responsibility it is to monitor positions on all elected or appointed state boards, commissions, and judicial offices.

(B) The Secretary shall keep an up-to-date compilation of the membership of all state elected or appointed boards, commissions, and judicial offices for legislators and interested citizens to know the current composition including vacancies, and indicating which positions expire within the next year. Records should also show the source of the appointments or which body elects the members of each board, commission, and judicial office.

(C) The Secretary shall publicize all vacancies, expired positions, and those expiring within one year on a quarterly basis in a manner that provides the widest distribution possible."

SECTION 2. This act takes effect upon approval by the Governor.
