A BILL

TO AMEND SECTION 56-5-2945, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PENALTIES ASSESSED AGAINST A PERSON WHO DRIVES UNDER THE INFLUENCE OF ALCOHOL, DRUGS, OR A COMBINATION OF ALCOHOL AND DRUGS, SO AS TO PROVIDE THAT A PERSON WHO HAS BEEN CONVICTED OF DRIVING UNDER THE INFLUENCE IN WHICH A DEATH OCCURS MAY ONLY APPLY FOR A SPECIAL RESTRICTED DRIVER'S LICENSE AFTER HE HAS COMPLETED HIS SENTENCE AND AFTER HIS MANDATORY PERIOD OF SUSPENSION HAS EXPIRED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-5-2945(B) of the 1976 Code, as last amended by Section 1419, Act 181 of 1993, is further amended to read:

"(B) As used in this section, `great bodily injury' means bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement, or protracted loss or impairment of the function of any bodily member or organ.

The department shall suspend the driver's license of any person who is convicted or who receives sentence upon a plea of guilty or nolo contendere pursuant to this section for a period to include any term of imprisonment plus three years. If, as a result of a person driving under the influence of alcohol, drugs, or the combination of alcohol and drugs, a death occurs, the convicted person may apply to the department after he has completed his sentence and after the period of mandatory license suspension has expired for a special restricted driver's license which permits him to drive only to work and church."

SECTION 2. This act takes effect upon approval by the Governor.
