TO PROHIBIT, UNDER CERTAIN CONDITIONS, A SERVICE CHARGE, TAX, OR BUSINESS LICENSE FEE IMPOSED IN ANY AREA OF LEXINGTON COUNTY THAT HAS BEEN ANNEXED BY A MUNICIPALITY AND TO PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) No uniform service charge, tax, or business license fee may be imposed in any area of Lexington County that has been annexed by a municipality if:
(1) the annexed area of the county was unincorporated as of January 1, 1996, and subsequently annexed by the municipality; and
(2) the governing body of the county in which the annexed area is located has not agreed to the annexation.
(B) The provisions of this section do not apply to the following municipalities in Lexington County: Cayce, Chapin, Gaston, Gilbert, Lexington, Pelion, Pine Ridge, South Congaree, Springdale, Summit, Swansea, and West Columbia, or to any other municipality in Lexington County exempted by the Lexington County Council.
SECTION 2. This act takes effect upon approval by the Governor.
