TO PROHIBIT UNTIL JULY 1, 1997, THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL FROM ISSUING A PERMIT OR APPROVING AN APPLICATION TO OPERATE A LANDFILL AT 104 OMAR COURT IN LEXINGTON COUNTY AND TO REQUIRE THE SECRETARY OF STATE TO SEND A COPY OF THIS JOINT RESOLUTION TO EACH BOARD MEMBER OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL.
Amend Title To Conform
Whereas, a zoning permit recently has been approved for the construction of a landfill at 104 Omar Court in Lexington County; and
Whereas, concerns have been raised about the location of the site which is adjacent to a residential neighborhood; and
Whereas, the concerns raised include the potential for soil and water contamination and for medical problems of nearby residents that may be exacerbated by such an operation. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Until July 1, 1997, the Department of Health and Environmental Control may not issue a permit for mining, sand, clay, or fill-dirt or approve an application to operate any landfill located at 104 Omar Court in Lexington County or any other site in the immediate area of 104 Omar Court.
SECTION 2. The Secretary of State shall send a copy of this joint resolution to each board member of the Department of Health and Environmental Control.
SECTION 3. This joint resolution takes effect upon approval by the Governor.
