A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-70 SO AS TO PROHIBIT THE HUNTING OF GAME UNDER CERTAIN CONDITIONS, PROVIDE PENALTIES AND EXCEPTIONS, AND DEFINE TERMS; TO REPEAL SECTION 50-11-355 RELATING TO THE HUNTING OF DEER NEAR RESIDENCES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-11-70. It is unlawful to hunt big game within three hundred yards of a residence, business, or private or public dock without permission of the owner and occupant. It is unlawful to hunt small game and migratory waterfowl within two hundred yards of a residence, business, or private or public dock without permission of the owner and occupant. A person violating this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned not more than thirty days. This section does not apply to a landowner hunting on his own land."

SECTION 2. Section 50-11-355 of the 1976 Code is repealed.

SECTION 3. This act takes effect upon approval by the Governor.
