A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-1-85 SO AS TO PROVIDE RESTRICTIONS ON THE OPERATION OF FOUR-WHEEL ALL TERRAIN VEHICLES ON THE STATE'S PUBLIC HIGHWAYS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-1-85. Notwithstanding another provision of law, a person may not operate a four-wheel all terrain vehicle on the state's public highways unless he:

(1) possesses a beginner's permit, a restricted driver's license, or a driver's license;

(2) has successfully completed a course certified by the Department of Public Safety in the proper operation of four-wheel all terrain vehicles; and

(3) wears a helmet and other safety equipment that the department determines necessary while operating the vehicle."

SECTION 2. This act takes effect upon approval by the Governor.
