THE COMMITTEE ON JUDICIARY

To whom was referred a Bill (H. 4884), to amend the Code of Laws of South Carolina, 1976, by adding Section 16-3-1080 so as to provide that it is unlawful for a person who is incarcerated to communicate, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION 1. The 1976 Code is amended by adding:

"Section 16-3-1080. It is unlawful for a person who is incarcerated to communicate to another person that he intends to commit a violent crime when he is released from custody. A person convicted under this section must be imprisoned for not more than ten years."

SECTION 2. This act takes effect upon approval by the Governor./

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-1080 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON WHO IS INCARCERATED TO COMMUNICATE TO ANOTHER PERSON HIS INTENT TO COMMIT A CRIME ONCE HE IS RELEASED FROM CUSTODY AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-3-1080. It is unlawful for a person who is incarcerated to communicate to another person that he intends to commit a crime when he is released from custody. A person convicted under this section must be punished according to the penalty provisions applicable to the crime he communicates that he intends to commit."

SECTION 2. This act takes effect upon approval by the Governor.
