A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 42-1-455 SO AS TO PROVIDE THAT PERSONS WHO ARE PARTNERS, SOLE PROPRIETORS, OR CORPORATE OFFICERS WHO HAVE GIVEN NOTICE OF NONACCEPTANCE OF THE PROVISIONS OF TITLE 42 ARE LIMITED TO THE SAME LEGAL REMEDIES POSSESSED BY A PERSON WHO HAS SECURED COVERAGE UNDER A POLICY OF WORKERS' COMPENSATION INSURANCE, AND PROVIDE THAT NO CONTRACTOR IS LIABLE UNDER TITLE 42 FOR WORK-RELATED INJURIES OR ILLNESSES OF THE EMPLOYEES OF UNINSURED SUBCONTRACTORS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 42-1-455. Notwithstanding any other provision of this chapter, persons who are partners, sole proprietors, or corporate officers who have given notice of nonacceptance of the provisions of this title are limited to the same legal remedies possessed by a person who has secured coverage under a policy of workers' compensation insurance, and no contractor is liable under this title for the work-related injuries or illnesses of the employees of uninsured subcontractors."

SECTION 2. This act takes effect upon approval by the Governor.
