A BILL

TO AMEND SECTION 16-1-10 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CATEGORIZATION OF FELONIES AND MISDEMEANORS, SO AS TO PROVIDE THAT ALL OFFENSES CLASSIFIED AS EXEMPT UNDER SECTION 16-1-10(D), FOR WHICH THE MAXIMUM PENALTY IS IMPRISONMENT FOR FIVE YEARS OR MORE, ARE FELONIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-1-10 of the 1976 Code is amended by adding a subsection to read:

"( ) All offenses classified in subsection (D) as exempt under subsections (A) and (B), for which the maximum penalty is imprisonment for five years or more, are felonies."

SECTION 2. This act takes effect upon approval by the Governor.
