A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 27-37-85 SO AS TO PERMIT EJECTMENT OF A TENANT DESPITE THE FACT THAT THE TENANT MAY HAVE FILED FOR BANKRUPTCY OR BEEN DECLARED BANKRUPT WHENEVER THE TENANT HAS FAILED TO FILE FOR BANKRUPTCY OR HAS NOT BEEN DECLARED BANKRUPT UNTIL AFTER EJECTMENT PROCEEDINGS OR TRIAL HAS BEEN HAD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 27-37-85. Notwithstanding any other provision of law, the ejectment of a tenant must be allowed, if the grounds for ejectment exist pursuant to law, despite the fact that the tenant may have filed for bankruptcy or been declared bankrupt, whenever the tenant has failed to file for bankruptcy or has not been declared bankrupt until after ejectment proceedings or trial as provided for in this chapter has been had."

SECTION 2. This act takes effect upon approval by the Governor.
