TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-3-445 SO AS TO PROVIDE THAT ANY PERSON WHO OBTAINS A JUDGMENT AGAINST ANOTHER PERSON FOR FAILURE TO PAY AN INSTALLMENT DEBT OBLIGATION REGARDING THE SALE OF A MOTOR VEHICLE MAY FILE A CERTIFIED COPY OF THE JUDGMENT WITH THE DEPARTMENT OF REVENUE AND TAXATION, TO PROVIDE THAT THE DEPARTMENT MAY NOT ISSUE OR RENEW A SOUTH CAROLINA DRIVER'S LICENSE FOR THE PERSON AGAINST WHOM THE JUDGMENT IS ENTERED OR ISSUE ANY NEW LICENSE PLATES OR VALIDATION STICKERS FOR A MOTOR VEHICLE OWNED BY THAT PERSON SO LONG AS THE JUDGMENT REMAINS UNSATISFIED, AND TO PROVIDE FOR THE MANNER IN WHICH THE DEPARTMENT MUST BE NOTIFIED OF THE SATISFACTION OF THE JUDGMENT AND FOR THE PENALTIES AND REMEDIES FOR FAILURE TO NOTIFY THE DEPARTMENT OF THE SATISFACTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 56-3-445. Any person who obtains a judgment against another person for failure to pay an installment debt obligation regarding the sale of a motor vehicle may file a certified copy of such judgment with the Department of Revenue and Taxation. Upon receipt of a certified copy of that judgment, the department may not issue or renew a South Carolina driver's license for the person against whom the judgment is entered or issue any new license plates or validation stickers for a motor vehicle owned by that person so long as the judgment remains unsatisfied. The person obtaining the judgment must notify the department by affidavit of the satisfaction of the judgment within thirty days of the satisfaction. Any person obtaining the judgment who fails to notify the department in the manner required by this section of the satisfaction thereof is subject to the same penalties and remedies to which a person who fails to enter satisfaction of a mortgage after payment is subject as provided by law."
SECTION 2. This act takes effect upon approval by the Governor.
