A BILL

TO AMEND SECTION 30-4-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM DISCLOSURE UNDER THE FREEDOM OF INFORMATION ACT INCLUDING AN EXEMPTION FOR THE NAME, ADDRESS, AND TELEPHONE NUMBER OF A PERSON IN WHOSE NAME A MOTOR VEHICLE LICENSE PLATE IS REGISTERED AND EXCEPTIONS TO THIS PROVISION, SO AS TO PROVIDE THAT THIS EXEMPTION DOES NOT APPLY TO WRECKER SERVICES AND PRIVATE DETECTIVE AGENCIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The unnumbered item added to Section 30-4-40(a) of the 1976 Code by Act 1 of 1995, bearing Ratification Number 513 of 1994, is amended to read:

"( ) the name, address, and telephone number of a person in whose name a motor vehicle license plate is registered; provided, however, this exemption from disclosure shall not apply to an active duty law enforcement officer, wrecker services, private detective agencies, or agency authorized by law to have access to this information."

SECTION 2. This act takes effect upon approval by the Governor.
