A BILL

TO PROVIDE FOR THE RECOVERY OF CERTAIN MONETARY ITEMS BY A PERSON COLLECTING A DEBT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Notwithstanding any other provision of law, a person collecting an ordinary debt, either by a valid written contract or by the performance of an enforceable oral contract, shall be entitled to:

(1) the agreed-upon price;

(2) late charges to be assessed at one percent per annum per month compounded monthly;

(3) costs, including time expended going to and from court and appearing in court to collect the debt; and

(4) lost wages, if any, as a result of going to and from court and for appearing in court to collect the debt and for filing any defense as may be necessary in the action to collect the debt.

SECTION 2. This act takes effect upon approval by the Governor.
