TO AMEND SECTION 59-25-120, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENT THAT PERSONS APPLYING FOR TEACHERS' CERTIFICATES PASS AN EXAMINATION ON THE CONSTITUTION OF THE UNITED STATES AND SATISFY THE BOARD OF EXAMINERS OF THEIR LOYALTY TO THE UNITED STATES AND ITS CONSTITUTION, SO AS TO PROVIDE THAT NO PERSON IS REQUIRED TO BE A UNITED STATES CITIZEN IN ORDER TO BE CERTIFIED AS A TEACHER IN THIS STATE, AND TO PROVIDE THAT THE STATE BOARD OF EDUCATION BY REGULATION SHALL PROVIDE FOR ALTERNATE MEANS WHEREBY APPLICANTS WHO ARE NOT CITIZENS OF THE UNITED STATES MAY SATISFY THE BOARD OF EXAMINERS OF THEIR LOYALTY TO THE UNITED STATES AND ITS CONSTITUTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 59-25-120 of the 1976 Code is amended to read:
"Section 59-25-120. All persons applying for certificates authorizing them to become teachers in the public schools of this State shall, in addition to other requirements and before receiving such certificate, shall be required to pass a satisfactory examination upon the provisions and principles of the Constitution of the United States and shall also shall satisfy the examining power of their loyalty thereto.
No person is required to be a United States citizen in order to be certified as a teacher in this State as provided by law, and the State Board of Education by regulation shall provide for alternate means whereby applicants who are not citizens of the United States may satisfy the examining power of their loyalty to the United States and its Constitution."
SECTION 2. This act takes effect upon approval by the Governor.
