TO AMEND ARTICLE 7, CHAPTER 13, TITLE 8 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-13-800 SO AS TO PROVIDE THAT NO PUBLIC OFFICIAL MAY CARRY OUT THE DUTIES OF HIS OFFICE OR ENFORCE THE LAW IN A RACIALLY OR POLITICALLY DISCRIMINATORY MANNER.
Whereas, public officers are elected and appointed based on their perceived willingness to fulfill the public trust; and
Whereas, it appears that certain public officials carry out the duties and functions of their offices or enforce the law in a selective manner, based upon racial, political, or other considerations which have the tendency to undermine and erode the public trust; and
Whereas, public officials who act as described herein should be rebuked so as to preserve a sense of fundamental fair dealing and justice in society. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 7, Chapter 13, Title 8 of the 1976 Code is amended by adding:
"Section 8-13-800. No public official may carry out the duties of his office or enforce the law in a racially or politically discriminatory manner. For purposes of this section, the phrase `racially or politically discriminatory manner' means the enforcement of the law or performance of official duties in a way that results in the disparate treatment of otherwise similarly situated individuals or groups, which disparities can be demonstrated to be substantially related to the race or political affiliation of an individual, or in the case of a group, the predominate racial or political composition of the group."
SECTION 2. This act takes effect upon approval by the Governor.
