ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES IS:
Department of Health and Human Services indicates that since the salaries of the employees of the councils of aging are funded at the local level, there will be no additional cost to the General Fund of the State if this bill is passed.
A review by the Department of Health and Human Services indicates that for the fiscal year 1997-98, there was a total of $12,865,230 allocated for salaries to the councils of aging and local providers in the state's forty-six counties. Therefore, based on the employer contribution rate for the regular retirement system of 9.616%, it is estimated if all the councils of aging elect to participate, they will incur an additional annual cost of $1.24 million.
The bill has no substantive fiscal impact on the retirement system, since the local councils of aging and employees are required to contribute to the system in the same manner and at the same rates as present employers and employees.

TO AMEND SECTION 1-11-720, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ENTITIES WHOSE EMPLOYEES AND RETIREES ARE ELIGIBLE FOR STATE HEALTH AND DENTAL INSURANCE PLANS, SO AS TO CLARIFY THAT THE DIVISION ON AGING IS UNDER THE DEPARTMENT OF HEALTH AND HUMAN SERVICES RATHER THAN UNDER THE OFFICE OF THE GOVERNOR; AND TO AMEND SECTION 9-1-10, AS AMENDED, RELATING TO DEFINITIONS USED IN THE SOUTH CAROLINA RETIREMENT SYSTEM, SO AS TO AMEND THE DEFINITION OF "EMPLOYEE" AND "EMPLOYER" SO AS TO INCLUDE EMPLOYEES OF LOCAL COUNCILS ON AGING IN THE STATE RETIREMENT SYSTEM.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 1-11-720(A)(9) of the 1976 Code, as last amended by Section 81, Part II, Act 458 of 1996, is further amended to read:
"(9) county local councils on aging or other governmental agencies providing aging services funded by the Office of the Governor, Division on Aging, Department of Health and Human Services;"
SECTION 2. Section 9-1-10(4) of the 1976 Code, as last amended by Section 48A, Part II, Act 458 of 1996, is further amended by adding after the lettered subitems and before the final paragraph of item (4) an appropriately lettered subitem to read:
"( ) an employee of a local council on aging or other governmental agency providing aging services funded by the Office on Aging, Department of Health and Human Services."
SECTION 3. Section 9-1-10(5) of the 1976 Code, as last amended by Act 162 of 1991, is further amended to read:
"(5) 'Employer' means the State, a county board of education, a district board of trustees, a city board of education, the board of trustees or other managing board of a state-supported college or educational institution, or any other agency of the State by which a teacher or employee is paid; the term 'employer' also includes a county, municipality, or other political subdivision of the State, or an agency or department thereof, which has been admitted to the system under the provisions of Section 9-1-470, a service organization referred to in paragraph (4) of this section, and an alcohol and drug abuse planning agency authorized to receive funds pursuant to Section 61-12-20, and a local council on aging or other governmental agency providing aging services funded by the Office on Aging, Department of Health and Human Services;"
SECTION 4. This act takes effect July 1, 1998.
