AN ACT TO AMEND SECTION 56-1-2070, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE COMMERCIAL MOTOR VEHICLE LICENSES, SO AS TO ADOPT FEDERAL EXEMPTIONS ALLOWING FOR THE TRANSPORTATION OF CERTAIN HAZARDOUS WASTE MATERIALS WHICH POSE NO SUBSTANTIAL THREAT TO PUBLIC HEALTH AND SAFETY WHEN USED IN NORMAL FARMING OPERATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

Transportation of agricultural products, machinery, and supplies

SECTION 1. Section 56-1-2070(B)(2)(b) of the 1976 Code is amended to read:

(b) used to transport agricultural products, farm machinery, farm supplies, or a combination of them to or from a farm including the transportation of hazardous materials which do not pose a substantial danger to the public health and safety including fuels, fertilizers, and other agricultural chemicals used in normal farming operations as exempted pursuant to 49 C.F.R Part 173.5;

SECTION 2. This act takes effect upon approval by the Governor.
