A BILL

TO AMEND SECTIONS 57-7-210 AND 57-7-220, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO OBSTRUCTIONS ON PUBLIC HIGHWAYS, SO AS TO ALLOW THE DEPARTMENT OF TRANSPORTATION TO APPROVE OBSTRUCTIONS ERECTED BY LOCAL GOVERNMENTS, INCLUDING SCHOOL DISTRICTS, IF THE OBSTRUCTION IS INTENDED TO PROTECT PROPERTY FROM VANDALISM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Sections 57-7-210 and 57-7-220 of the 1976 Code are amended to read:

"Section 57-7-210. It shall be unlawful for any person wilfully to obstruct ditches and drainage openings along any highway, to place obstructions upon any such highway, or to throw or place on any such highway any objects likely to cut or otherwise injure vehicles using them. A violation of this section shall be punishable by a fine of not more than one hundred dollars or imprisonment for not more than thirty days. Nothing in this chapter shall prohibit the department from approving obstructions erected by local governments, including school districts, if the obstruction is intended to protect property from vandalism.

Section 57-7-220. Any time during the year when any public highway shall be obstructed, any overseer of the district in which it may be the department shall forthwith cause such obstruction to be removed."

SECTION 3. This act takes effect upon approval by the Governor.
