A BILL

TO AMEND CHAPTER 71, TITLE 38, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-71-125, SO AS TO REQUIRE INSURANCE POLICIES AND HEALTH MAINTENANCE ORGANIZATIONS TO PAY FOR HOSPITALIZATION FOR AT LEAST TWENTY-FOUR HOURS FOLLOWING A MASTECTOMY, AND TO PROVIDE FOR EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 71, Title 38 of the 1976 Code is amended by adding:

"Section 38-71-125. All individual and group health insurance policies and health maintenance organizations providing coverage for the hospitalization of a woman shall pay for hospitalization for at least twenty-four hours following a mastectomy. A mastectomy includes surgical procedures for a segmental, simple, modified radical, and radical. Nothing in this section shall be construed to prohibit an attending physician from releasing the woman prior to the expiration of the time provided herein, if the woman requests an early release and the physician concurs with the request."

SECTION 2. This act takes effect upon approval by the Governor.
