A BILL

TO AMEND SECTION 30-4-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MATTERS WHICH ARE EXEMPT FROM DISCLOSURE UNDER THE PROVISIONS OF THE FREEDOM OF INFORMATION ACT, SO AS TO PROVIDE THAT INFORMATION RECEIVED AND COMPILED BY A GOVERNMENTAL ENTITY REGARDING PROPRIETARY FUNCTIONS OF ITS CUSTOMERS MAY NOT BE RELEASED BY THE GOVERNMENTAL ENTITY EXCEPT FOR CERTAIN PURPOSES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 30-4-40(a) of the 1976 Code is amended by adding a new appropriately numbered item to read:

"( ) Information received and compiled by a governmental entity as a result of the entity providing proprietary functions to its customers, including, but not limited to, a customer's monthly utility charges and a master list of the entity's customers. This subsection shall not be construed to prevent the entity from releasing a customer's personal information to the customer, nor to prevent the entity from responding to disclosure requests regarding internal operations, budgeting, personnel, and other governmental functions."

SECTION 2. This act takes effect upon approval by the Governor.
