TO AMEND SECTION 2-7-72, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENT FOR A FISCAL IMPACT STATEMENT ON A BILL OR RESOLUTION REQUIRING THE EXPENDITURE OF FUNDS, SO AS TO EXTEND THE REQUIREMENT TO CERTAIN AMENDMENTS, AND TO PROVIDE THAT AMENDMENTS FAILING TO HAVE THE FISCAL IMPACT STATEMENT ATTACHED MAY NOT BE CONSIDERED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 2-7-72 of the 1976 Code, as last amended by Act 658 of 1988, is further amended to read:
"Section 2-7-72. (A) Whenever When a bill or resolution is introduced in the General Assembly requiring the expenditure of funds, the principal author shall affix a statement of estimated fiscal impact and cost of the proposed legislation. Before reporting the bill out of committee, if the amount is substantially different from the original estimate, the committee shall attach a statement of estimated fiscal impact to the bill signed by the Director of the State Budget Division of the State Budget and Control Board or his designee. As used in this section, 'statement of estimated fiscal impact' means the opinion of the person executing the statement as to the dollar cost to the State for the first year and the annual cost thereafter.
(B) An amendment offered in the House of Representatives or the Senate, which if introduced as separate legislation would require the statement of fiscal impact provided pursuant to subsection (A) of this section, may not be considered unless such a statement is attached to the amendment at the time of its consideration. This subsection does not apply to an amendment to the annual general appropriations bill or any supplemental appropriations bill or joint resolution."
SECTION 2. This act takes effect July 1, 1997.
