A BILL

TO AMEND SECTION 22-2-130, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PENALTY FOR FAILURE TO APPEAR FOR JURY SERVICE IN MAGISTRATE'S COURT AND THE NUMBER OF TIMES A PERSON MAY SERVE ON A JURY THEREIN, SO AS TO PROVIDE THAT NO PERSON SHALL SERVE ON A JURY IN MAGISTRATE'S COURT MORE THAN ONCE EVERY THREE CALENDAR YEARS RATHER THAN ONCE EVERY THREE MONTHS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 22-2-130 of the 1976 Code is amended to read:

"Section 22-2-130. If any juror duly summoned shall neglect or refuse to appear in obedience to any venire issued by any magistrate's court and shall not within forty-eight hours shall not render to the summoning magistrate a sufficient reason for his delinquency, he shall forfeit and pay a fine of ten dollars to the treasury of the county in which the case is tried, to be assessed by such magistrate and collected on his warrant without other process. A failure to pay forthwith such the fine so assessed shall constitute constitutes a contempt of court and shall be punished accordingly. No person shall serve on a jury in a magistrate's court more than once in a three-month period every three calendar years."

SECTION 2. This act takes effect upon approval by the Governor.
