TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-761 SO AS TO PROHIBIT THE SHOOTING OR HUNTING OF BIG GAME FROM ANY PUBLIC, PAVED ROAD IN GAME ZONES 1, 2, AND 4, PROVIDE FOR PENALTIES AND EXEMPTIONS, AND PROVIDE FOR RELATED MATTERS; AND TO REPEAL SECTION 50-11-760 RELATING TO HUNTING OF ALL GAME FROM CERTAIN PUBLIC ROADS AND RAILROAD RIGHTS-OF-WAY AND PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 50-11-761. (A) The shooting or hunting of big game from any public, paved road is prohibited in Game Zones 1, 2, and 4.
(B) As used in this section, the term `shooting or hunting of big game' includes, but is not limited to: occupying stands for hunting while in possession of shotguns loaded with shot larger than Number Four (#4) or any rifle or pistol loaded with ammunition larger than .22 caliber or muzzle loading rifles of .36 caliber or larger, muzzle loading shotguns larger than 20 gauge, or any archery equipment.
(C) Persons shooting or hunting for big game may not do so within fifty feet of the edge of the pavement of any paved road nor within any maintained right-of-way of such a road.
(D) No person may hunt from any unpaved road unless he has permission to hunt on adjacent property.
(E) Any person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than one hundred dollars and not more than five hundred dollars or imprisoned not more than thirty days.
(F) The provisions of this section do not apply to a duly authorized law enforcement officer acting in the line of duty or to persons otherwise authorized by law."
SECTION 2. Section 50-11-760 of the 1976 Code is repealed.
SECTION 3. This act takes effect upon approval by the Governor.
