A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-95 SO AS TO MAKE IT UNLAWFUL KNOWINGLY AND MALICIOUSLY TO INFLICT OR ALLOW A PERSON TO INFLICT GREAT BODILY HARM UPON A CHILD AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-3-95. (A) It is unlawful to:

(1) inflict great bodily injury upon a child; or

(2) knowingly allow a person who with knowledge and malice inflicts great bodily injury upon a child.

(B) A person who violates:

(1) subsection (A)(1) is guilty of a felony and, upon conviction, must be imprisoned not more than ten years;

(2) subsection (A)(2) is guilty of a felony and, upon conviction, must be imprisoned not more than five years.

(C) For purposes of this section 'great bodily injury' means bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ."

SECTION 2. This act takes effect upon approval by the Governor.
