A BILL

TO AMEND SECTION 27-37-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE EJECTMENT OF A TENANT FOR FAILURE TO APPEAR AT A SHOW CAUSE HEARING, SO AS TO PROVIDE THAT A TENANT IS GUILTY OF TRESPASS IF HE FAILS TO VACATE A PROPERTY AFTER HE HAS BEEN EJECTED, AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 27-37-40 of the 1976 Code is amended to read:

"Section 27-37-40. (A) If the tenant fails to appear and show cause within the aforesaid ten days then the magistrate shall issue a warrant of ejectment and the tenant shall must be ejected by his regular or special constable or by the sheriff of the county.

(B) If the tenant remains on the property after he has been ejected, he is guilty of trespass and, upon conviction, must be fined not more than one hundred dollars or be imprisoned not more than thirty days."

SECTION 2. This act takes effect upon approval by the Governor.
