TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 28-2-65 SO AS TO AUTHORIZE THE STATE TO ACQUIRE PROPERTY OF HISTORICAL VALUE BY CONDEMNATION AND TO REQUIRE THE STATE TO PRESERVE AND PROTECT SUCH PROPERTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 28-2-65. (A) For purposes of this chapter, acquisition of an interest in real property necessary for any public purpose includes a condemnation action to acquire real property of historical value by reason of any war in which the United States of America or any section of the United States of America participated or by reason of any historical event.
(B) Upon acquiring the property, the State shall preserve and protect the property and its historical value. The property referred to in this section includes, but is not limited to, battlefields, ruins of forts, and remains of military operations during any war."
SECTION 2. This act takes effect upon approval by the Governor.
