A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 7-13-200 SO AS TO PROVIDE THAT IF A VACANCY OCCURS IN A LOCAL OFFICE IN A COUNTY WHICH ELECTS ITS LOCAL OFFICERS, IT MUST BE FILLED FOR THE REMAINDER OF THE UNEXPIRED TERM BY APPOINTMENT OF THE GOVERNOR UPON THE RECOMMENDATION OF A MAJORITY OF THE MEMBERS OF THE COUNTY LEGISLATIVE DELEGATION REPRESENTING THAT COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 7-13-200. (A) As used in this section 'local office' means any popularly elected office for which the Governor has the authority to fill a vacancy.

(B) If a vacancy occurs in a local office in a county which elects its local officers, it must be filled for the remainder of the unexpired term by appointment of the Governor upon the recommendation of a majority of the members of the local legislative delegation representing that county."

SECTION 2. This act takes effect upon approval by the Governor.
