A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-2925 SO AS TO PROVIDE FOR THE FELONY OFFENSE OF NEGLIGENT HOMICIDE, AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-2925. When the death of a person ensues within one year as a proximate result of injury received by the driving of a vehicle in a negligent manner, the person operating the vehicle is guilty of negligent homicide. A person who is convicted of, pleads guilty to, or pleads nolo contendere to negligent homicide is guilty of a felony and, upon conviction, must be fined not more than one thousand dollars or imprisoned not more than three years, or both. The department shall revoke for three years the driver's license of a person convicted of negligent homicide."

SECTION 2. This act takes effect upon approval by the Governor.
