TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-1-115 SO AS TO PROVIDE THAT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, ANOTHER STATE AGENCY OR DEPARTMENT, OR A PERSON ACTING ON THEIR BEHALF, SHALL NOT DISTRIBUTE CONDOMS OR OTHER TYPES OF CONTRACEPTIVES TO A PERSON UNDER SIXTEEN YEARS OF AGE WITHOUT THE WRITTEN CONSENT OF A PARENT, GUARDIAN, OR ONE ACTING IN LOCO PARENTIS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 44-1-115. Notwithstanding another provision of law, the Department of Health and Environmental Control, another state agency or department, or a person acting on their behalf, shall not distribute condoms or other types of contraceptives to a person under sixteen years of age without the written consent of a parent, guardian, or one acting in loco parentis."
SECTION 2. This act takes effect July 1, 1998.
