TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-29 SO AS TO MAKE IT UNLAWFUL TO HUNT MIGRATORY WATERFOWL ON CERTAIN PORTIONS OF POTATO CREEK AND WYBOO CREEK IN CLARENDON COUNTY WITHIN ONE HUNDRED FIFTY YARDS OF A DWELLING WITHOUT WRITTEN PERMISSION OF THE LANDOWNER AND TO PROVIDE PENALTIES FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 50-11-29. (A) It is unlawful to hunt migratory waterfowl within one hundred fifty yards from any residence without the written permission of the landowner on property located from secondary road S-14-260 to the mouth of Potato Creek in Clarendon County.
(B) It is unlawful to hunt migratory waterfowl within one hundred fifty yards from any residence on Wyboo Creek in Clarendon County without the written permission of the landowner located from Highway SC-260 to the mouth of Birch Branch in Clarendon County.
(C) A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
