TO APPROVE REGULATIONS OF THE DEPARTMENT OF PUBLIC SAFETY, RELATING TO HIGHWAY PATROL, WRECKER SERVICES, DESIGNATED AS REGULATION DOCUMENT NUMBER 2184, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Public Safety, relating to highway patrol, wrecker services, designated as Regulation Document Number 2184, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.
State government restructuring of 1993, 1976 Code Sections 23-6-20 and 23-6-400, et seq., transferred the Highway Patrol Division from the old Department of Highways and Public Transportation to the Department of Public Safety. Section 23-6-30 of the 1976 Code requires the Department of Public Safety to formulate regulations to administer the duties and responsibilities transferred to it by restructuring. Section 23-6-20 provides that the rules, regulations, standards, orders, or other actions of the entities transferred to the Department of Public Safety shall remain in effect unless specifically changed or voided by the department in accordance with the Administrative Procedures Act.
To satisfy the requirements of Section 23-6-30, the department is repealing existing wrecker rotation regulation currently found in Regulation 63-600 of the old Department of Highways and Public Transportation regulations and is recodifying this regulation, with a few changes, in a section designated for the South Carolina Department of Public Safety.
