A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 16-23-285 AND 16-23-290 SO AS TO PROVIDE THAT IT IS UNLAWFUL TO BUY, SELL, TRANSPORT, PAWN, RECEIVE, OR POSSESS CERTAIN WEAPONS AND PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-23-285. (A) A person shall not knowingly buy, sell, transport, pawn, receive, or possess a stolen machine gun, shotgun or rifle, or one of these weapons from which the original serial number has been removed or obliterated.

(B) A person who violates a provision contained in subsection (A) is guilty of a felony and, upon conviction, must be fined not more than two thousand dollars or imprisoned not more than five years, or both."

SECTION 2. The 1976 Code is amended by adding:

"Section 16-23-290. (A) A person convicted of a felony or a crime of violence in a federal court or in a court of any state, commonwealth, territory, possession, or of the District of Columbia may not transport, pawn, receive, or possess a machine gun, shotgun, or rifle.

(B) A person who violates a provision contained in subsection (A) is guilty of a felony and, upon conviction, must be fined not more than two thousand dollars, or imprisoned not more than five years, or both."

SECTION 3. This act takes effect upon approval by the Governor.
