TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 41-1-45 SO AS TO PROVIDE THAT AN EMPLOYER BEFORE HIRING CERTAIN NEW EMPLOYEES TO WORK UNDER SPECIFIED JOB CONDITIONS, MAY FIRST REQUIRE THE PROSPECTIVE EMPLOYEE TO FURNISH THE EMPLOYER WITH A COPY OF HIS SLED OR FBI CRIMINAL RECORDS HISTORY AT THE EMPLOYEE'S EXPENSE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 41-1-45. An employer, before hiring a new employee after the effective date of this section for a job which will normally require him to work some hours other than 8:30 a.m. to 5:00 p.m., Monday through Friday, at a location where under regular circumstances less than three other people also may be employed during those hours, may first require the prospective employee to furnish the employer with a copy of his SLED or FBI criminal records history. This criminal records history must be dated within thirty days of the time the employee first interviewed or applied for that employment. The cost of the criminal records history must be paid by the prospective employee."
SECTION 2. This act takes effect upon approval by the Governor.
