TO APPROVE REGULATIONS OF THE DEPARTMENT OF LABOR, LICENSING AND REGULATION, BOARD OF PHARMACY, RELATING TO EXAMINATION FEES, DESIGNATED AS REGULATION DOCUMENT NUMBER 2037, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Labor, Licensing and Regulation, Board of Pharmacy, relating to examination fees, designated as Regulation Document Number 2037, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.

Section 40-43-70 states "The fee for examining an applicant to be a licensed pharmacist must be set by regulation in an amount sufficient to cover the cost and administration of the examination." The current regulation states "not to exceed two hundred fifty dollars," however the board is currently charging only $220 per candidate and has been doing so since 1988. Even at the limit of $250, the fee would only cover our cost for the test booklet and leave nothing for the cost of administration. The difference between the cost of the test booklet and the examination fee is used not only for the actual administration of the NABPLEX, but for the preparation and administration of the Jurisprudence Examination, as well as costs incurred for all licensure activities from the printing of the examination applications, processing and approval, study material provided to applicants, a great deal of correspondence, including postage through the permanent hand-lettered parchment license.
